Please
read this contract, (which includes the
Order Form) and these terms and conditions
carefully, before entering into this contract
with us. By ordering a Mobile Phone from
Us, you agree to be bound by the terms and
conditions of this Contract. You will also
be subject to the terms and conditions of
the Network Provider. If you are uncertain
about any of the terms and conditions, then
please discuss the matter with one of our
representatives before ordering a Mobile
Phone.
1. Definitions
1.1 In this Contract
“Contract” means the order
form on the front sheet and these terms
and conditions;
“Credit” means the monthly
sum that We agree to reimburse You during
the Promotional Period;
“Mobile Phone” means the mobile
phone supplied by Us to You;
“Network ” means the relevant
Network Providers.
“Network Provider” means the
company with whom You enter into a contract
to provide You with connection to Your mobile
Phone;
“Promotional Offer” means
the offer that We make to You for the provision
of a Mobile Phone and Tariff at a discounted
rate;
“Promotional Period” means
the duration of the Promotional Offer;
“Tariff” means the talk plan
that You sign up to with the Network Provider;
“We, Us, Our” means Letz Talk
trading as Lets Talk Limited;
“You, Your, Yourself” means
the person to whom We supply the Mobile
Phone
2. General
2.1 All orders are subject to availability
and connection to a 12 month contract (or
longer) from the chosen Network Provider
2.2 All orders are accepted subject to status.
Prior to the supply of any order We will
contact the Network Provider to secure acceptance.
This process involves both credit scoring
and credit referencing. We will advise you
if there is any reason why We are not able
to fulfil your order, either in writing
or by telephone.
2.3 All orders are subject to acceptance
by Us. We reserve the right to reject any
order(s) taken for any reason without explanation.
Any advertisement or promotion by Us shall
be deemed to be an invitation to treat.
2.4 You warrant that all the personal information
which you are required to provide when you
register is true, accurate, current and
complete in all respects and that you are
not impersonating any other person or entity.
2.5 You must notify Us immediately of any
changes to your personal information in
writing.
2.6 All errors must be reported to Us within
seven days. Any error reporting must be
confirmed in detail in writing.
2.7 All prices are quoted in GB pounds currency
only.
2.8 You must be over eighteen years of age.
2.9 All offers and promotions are subject
to availability and may be withdrawn at
any time without notice.
2.10 All prices exclude VAT, delivery, insurance
unless expressly stated otherwise
2.11 You must provide Us with two proofs
of your current address, one of signature.
The proofs must be in a form that is acceptable
to us. Please see our list of acceptable
proofs. In addition you must sign and date
the Contract the day you receive the paperwork
from us. Unless we tell you otherwise you
must return the proofs and the signed and
dated Contract to us within 15 days of receipt
of the contract by you. In the event that
we do not receive the proofs, Contract and
any other paperwork we require within 15
days (in accordance with this clause) then
You will become liable for any costs incurred
by Us including (but not limited to) any
Network Provider charges that You or We
become liable to pay.
3.
Promotional Offer
3.1 By entering into a Contract with Us
You may have chosen to take advantage of
Our Promotional Offer.
3.2 As part of the Promotional Offer, you
will receive a Mobile Phone and Tariff at
a discounted price.
3.3 The Promotional Offer is sold to You
on the basis that You do not during the
Promotional Period change Your Tariff or
have Your agreement with the Network Provider
terminated for any reason.
3.4 If during the Promotional Period You
do change Tariff and/or Your agreement with
the Network Provider is terminated for any
reason, We reserve the right to charge You
for the following amounts:-
3.4.1 the difference between the price that
You paid for the Mobile Phone and the full
recommended retail price of the Mobile Phone;
and
3.4.2 the amount of commission that We are
liable to repay to the Network Provider.
This sum could be up to £500.00 dependent
upon when the Tariff is changed and/or Your
agreement with the Network Provider is terminated.
WE DO NOT RECOMMEND THAT YOU CHANGE
YOUR TARIFF DURING THE PROMOTIONAL PERIOD
AND WE RECOMMEND THAT YOU CONTACT US TO
DISCUSS THE COSTS THAT YOU WILL BE LIABLE
FOR BEFORE CHANGING YOUR TARIFF.
3.5 During the Promotional Period, provided
that We are satisfied that You have not
changed Your Tariff, You have not damaged
or misused the phone or breached the Network
Providers terms and conditions and that
Your agreement with the relevant Network
Provider has not terminated, We will upon
receipt of a copy of Your monthly bill from
the Network Provider send to You a cheque
or electronic payment for the amount of
Credit. The payment will be sent within
sixty days of the completion of processing
of the paperwork by Us.
3.6 Any request to terminate the Contract
after the promotional period must be made
directly to the Network Provider. We are
not able to action any such notice sent
to us on your behalf.
4. Delivery
(Mail Orders Only)
4.1 Dates and/or times for delivery are
estimates only and are not guaranteed.
4.2 We will use all reasonable endeavours
to ensure delivery on the next working day
provided that the order is received by 1pm
UK local time and we are open. Any orders
received after 1pm local time will be treated
as having been received the following working
day.
4.3 Delivery to any UK mainland address
is free. Delivery to any offshore UK address
will be charged at standard postal rates
as applicable.
4.4 The Mobile Phone will be delivered to
You by courier and must be signed for. If
no-one is available to accept delivery,
a card will be left at that address with
details of how to arrange for the redelivery
of Your order. We will not be liable for
any delay in delivery. If the courier cannot
deliver because no-one is available then
it may be necessary for You to attend at
the courier’s depot to arrange collection.
